Privacy Policy

UGC Creatives LLC ("UGC Creatives", "we", "us" or "our") is a talent agency for creators who make selling videos for TikTok Shop and Meta. This Privacy Policy explains how we collect, use, share and protect personal information when you visit ugccreatives.co, apply to work with us as a creator or a brand, refer someone to us, receive our messages, or work with us (together, the "Services"). It also explains the rights you have and how to use them.
If you work with us under a written agreement, that agreement may add to this policy. Questions go to privacy@ugccreatives.co.
1. The short version
- We collect what you give us in an application or a message, what the people who refer you give us, and basic technical information from your browser.
- We use it to review applications, run our creator network and our work with brands, contact you, improve the Services and keep them secure.
- We share it with the service providers and data partners that help us run the business, including hosting, storage, email, messaging, workspace, analytics and AI providers, with Meta when you visit this site (for our ads on Facebook and Instagram), with brands when you create for them, and when the law requires it.
- We do not sell personal information for money. The Meta Pixel on this site shares your visits with Meta for our ads, which some US state laws call "sharing" for cross-context behavioral advertising. You can opt out as described in section 6.
- You can ask to see, correct, delete or get a copy of your information, and you can stop marketing messages, invitations and reminders at any time.
2. Information we collect
Information you give us
Creator applications. Your name, email address and WhatsApp number; where you live and how long it takes you to reach our in-person meetings; your languages and level; your availability, experience and whether you have made videos that sell; the phone you film on and your editing skills; your social media accounts and links to your work; how you heard about us; your gender, only if you choose to answer; your headshot and the test videos you upload, which include your image and voice; any notes you add; and your confirmations and consents.
Brand applications. Your name, work email and, if you give it, your phone or WhatsApp number; your brand name, website and social accounts; your category and markets; your TikTok Shop sales range; the products you want our creators to sell and their links; whether you can send products; your goals, budget range and timing; how you heard about us; and any notes.
Referrals. When you refer someone, we collect your name and contact details and the name and contact details of the person you refer, so we can send them an invitation on your behalf. Only refer people you know and who you believe would welcome hearing from us.
Your choices. The language you want our emails in, whether you want news and openings from us, and the consents you give, including the words you agreed to and when.
Messages and support. The emails, WhatsApp messages and other messages you send us, notes from our calls with you, and anything you attach.
If you join our network or become a client. Contract details; payment and tax information such as payout details and tax identification numbers; identity documents where the law or our payment providers require them; the content you create for brands; and information about how that content performs, such as views, engagement and sales.
Information we collect automatically
- Device and usage information: IP address, browser and device type, pages viewed, the page that sent you to us, dates and times, and an approximate location based on your IP address.
- Application progress: the answers you save as you go, in your browser's local storage and on our servers, the step you reached and whether you finished. This lets you pick up where you left off and lets us remind you to finish.
- Emails, links and referral codes: whether our emails were delivered, bounced or marked as spam, and, when you open an invitation or reminder link, the visit, the referral code and the channel it came through, such as email or a shared link.
Information from other sources
- Public sources: your public social media profiles and posts, and public information about brands and businesses.
- People who refer you: your name and contact details, as described above.
- Brands and platforms we work with: for example, how the content you create for a brand performs on TikTok Shop or Meta.
- Service providers and data partners: for example, to verify contact details, prevent fraud and spam, or add business information about brands.
3. How we use information
- To review applications and decide whether and how we can work together, including comparing applicants and considering you for future openings or campaigns.
- To communicate with you by email, WhatsApp, text message or phone: confirmations, reminders to finish an application you started, invitations sent for someone who referred you, updates and answers to your questions.
- To run our creator network and our services for brands: matching creators with brands, sending briefs, scripts and products, managing content, deliveries and payments, and reporting results.
- To run our referral program: sending invitations, recording who referred whom, and honoring opt-outs.
- To understand and improve the Services, including analytics, research, testing new features and training our team.
- To market our Services: news, openings and offers, with your consent where the law requires it. You can opt out at any time.
- To protect the Services and our users: security, fraud and spam prevention, and fixing problems.
- To meet legal obligations, enforce our Terms of Use and establish, exercise or defend legal claims.
- For any other purpose we tell you about when we collect the information, or with your consent.
Where the law asks for a legal basis, we rely on: taking steps before and during a contract with you; our legitimate interests in running and growing our business, recruiting creators and serving brands, and keeping the Services secure, balanced against your rights; your consent, such as for marketing; and our legal obligations.
4. AI and automated tools
We use software, including artificial intelligence (AI) tools provided by third parties, to process applications and business information. For example, we use these tools to organize and summarize applications, transcribe and describe videos, search our records, draft messages, and help our team compare applicants and plan campaigns. The providers of these tools are our service providers and data partners, and they process information on our behalf.
People on our team make the decisions about who we work with. We do not make decisions that have legal or similarly significant effects on you based solely on automated processing.
5. How we share information
We share personal information with the following recipients:
- Service providers and data partners. Companies that provide services to us or work with us to operate, analyze and improve our business. They include cloud hosting and file storage (Amazon Web Services), email and messaging providers (including WhatsApp and Meta), workspace and database tools where our team reviews applications (Notion), knowledge-management tools, and analytics (Google Analytics), AI and data-processing providers. They may use personal information only to provide their services to us and must protect it.
- Advertising partners. Meta Platforms receives information about your visits to this site through the Meta Pixel, to measure our ads on Facebook and Instagram and to show them to people who visited (see section 6). Meta uses it under its own privacy policy.
- Brands and business partners. If you create for us, the brands you work with receive the content you make for them and the information about you that the campaign needs, such as your name, public social profiles and how your content performs. We may also share a limited profile, such as your name, public accounts and sample content, with brands we are proposing you to. If you are a brand, the creators and team members working on your campaign receive your product and brief information.
- Affiliates. Companies that control, are controlled by or are under common control with UGC Creatives, under this policy.
- Professional advisers. Our lawyers, accountants, auditors and insurers.
- Legal and safety. Authorities and others when the law requires it, to respond to lawful requests, to enforce our terms, or to protect the rights, safety and property of UGC Creatives, our users or the public.
- Business transfers. A buyer, investor or successor as part of a merger, acquisition, financing, reorganization, sale of assets or similar transaction, under this policy.
- With your consent or at your direction.
We may also share information that has been combined with other data or stripped of details that identify you, in ways that do not identify you.
We do not sell personal information for money. The Meta Pixel described in section 6 may count as "sharing" for cross-context behavioral advertising under some US state laws.
6. Cookies, local storage and tracking
- Local storage. The applications save a draft of your answers in your browser so you can finish later. It stays there until you submit, clear your browser data, or it is replaced by a newer version of the form.
- Essential technologies. We use the technologies needed to run the site, remember your progress and keep the Services secure.
- Email and link tracking. Our emails and links may contain codes and similar technologies that tell us whether an email was delivered, opened or clicked. Referral links carry a code that tells us who referred you.
- Analytics (Google Analytics). This site uses Google Analytics, loaded through Google Tag Manager, to count visits and see how the site is used: the pages you view, clicks and scrolling, your browser and device, your approximate location from your IP address, and the fact that you sent an application, a message or a newsletter sign-up, but not your answers. It sets cookies. We have turned off Google's optional data sharing for our account. It does not load if your browser sends a Global Privacy Control signal, or if your device is set to a European time zone. You can also block it in your browser settings or with Google's opt-out browser add-on.
- Advertising (Meta Pixel). This site uses the Meta Pixel, a script from Meta Platforms that sets cookies and sends Meta the pages you visit, when you visit them, your IP address, browser and device details, and the fact that you sent an application, a message or a newsletter sign-up. When you send one of those forms, our server also sends Meta the same event with your email address and phone number in hashed form, so Meta can match it to an account. We do not send the rest of your answers. We use this to measure our ads on Facebook and Instagram and to show our ads to people who have visited the site. Meta may combine this with other information it holds about you, under its own privacy policy. The pixel does not load if your browser sends a Global Privacy Control signal, or if your device is set to a European time zone, where the law asks for your consent first. You can also block it in your browser settings or change your ad preferences in your Facebook or Instagram settings.
You can block or delete cookies and local storage in your browser settings, though parts of the applications may not work without them. Where the law requires it, we treat a Global Privacy Control signal from your browser as a request to opt out of the sale or sharing of your personal information.
7. Where we process information
We are based in the United States and store information on servers there. Our service providers and data partners may process it in the United States and other countries. If you use the Services from Mexico or anywhere else, your information will be transferred to and processed in the United States and other countries whose laws may differ from yours. Where the law requires it, we use contractual safeguards, such as standard contractual clauses, for these transfers.
8. How long we keep information
We keep personal information for as long as we need it for the purposes in this policy, and then delete it or remove the details that identify you. How long depends on the information and why we have it:
- Applications are kept while we consider you and afterwards, so we can consider you for future openings and campaigns, unless you ask us to delete them.
- Creator and client records, including contracts, payments and tax information, are kept for the relationship and for as long after it as tax, accounting and legal obligations require, which is often up to 7 years.
- Files uploaded but never submitted are deleted automatically after 3 days.
- Opt-out records for marketing, invitations and reminders are kept so we can keep honoring them.
9. How we protect information
We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls that limit information to the people and services that need it, and signed links to application files. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security breach that affects your information, we will notify you as the law requires.
10. Your rights and choices
Depending on where you live, you may have the right to:
- know what personal information we hold about you and get a copy of it, including in a portable format;
- correct information that is inaccurate;
- delete your information;
- object to or restrict how we use it;
- withdraw your consent, without affecting what we did before;
- opt out of the sale or sharing of personal information, targeted advertising and certain profiling; and
- appeal our decision on your request.
How to make a request. Email privacy@ugccreatives.co, ideally from the address you used with us, and tell us what you would like. We may ask for information to verify your identity before we act. You can use an authorized agent where the law allows; we may ask the agent for proof of your permission. We reply within the time the law sets for your location, for example 20 business days under Mexican law, 45 days under most US state laws and one month in the EEA and UK. If we decline your request, you can appeal by replying to our decision with the word "Appeal".
Marketing, invitations and reminders. Use the unsubscribe link in any of our emails, reply STOP to our WhatsApp or text messages, or email us. Opting out of marketing does not stop messages about an application or work you have with us.
We will not discriminate against you for exercising your rights. Residents of Mexico can exercise their ARCO rights as explained in the aviso de privacidad.
11. Notice for US state residents
This section adds to the rest of this policy for residents of California and other US states with consumer privacy laws. In the past 12 months we have collected the following categories of personal information, from the sources in section 2, for the purposes in section 3, and disclosed them for business purposes to the recipients in section 5:
- Identifiers, such as name, email address, phone number, IP address and social media handles.
- Customer records, such as contact details and, for creators in our network and for clients, payment and tax information.
- Characteristics of protected classifications, such as gender, only if you choose to share it, and confirmation that you are 18 or older.
- Commercial information, such as a brand's products, sales range and budget.
- Internet or other electronic network activity, such as application progress and email and link activity.
- Approximate geolocation, such as the area where you live or a location based on your IP address.
- Audio, electronic and visual information, such as your headshot and videos.
- Professional or employment-related information, such as your experience, skills and work history.
- Sensitive personal information, only where you give it to us for payments or the law requires it, such as a government identification number. We do not use sensitive personal information to infer characteristics about you.
- Inferences, such as our assessment of your fit for a role or campaign.
We do not sell personal information for money. Through the Meta Pixel (section 6) we share identifiers, such as IP address, cookie IDs and hashed email addresses and phone numbers, and internet activity on this site with Meta for cross-context behavioral advertising. You can opt out with a Global Privacy Control signal, in your browser settings, or by emailing us. We have no actual knowledge of selling or sharing the information of anyone under 16. We keep each category as described in section 8. You can use the rights in section 10. California residents may also ask about disclosures to third parties for their own direct marketing; we do not make them.
12. Notice for the EEA, UK and Switzerland
UGC Creatives LLC is the controller of your personal information. We rely on the legal bases in section 3, transfer information as described in section 7, and you have the rights in section 10. You also have the right to complain to the data protection authority where you live or work.
13. Children
The Services are for people who are 18 or older. We do not knowingly collect personal information from anyone younger. If we learn that we have, we will delete it.
14. Other sites and platforms
The Services link to and work with platforms we do not control, such as TikTok, Instagram, WhatsApp and ChatGPT. Their own terms and privacy policies apply when you use them.
15. Changes to this policy
We may update this policy from time to time. We will post the new version here with a new date.

Datos que tratamos. De identificación y contacto (nombre, correo, número de WhatsApp o teléfono); de ubicación general (zona donde vives); académicos y laborales (idiomas, experiencia, habilidades, disponibilidad); tu imagen y tu voz (tu foto y tus videos de prueba); tus redes sociales y los enlaces a tu trabajo; tu género, solo si decides responder; si aplicas como marca, los datos de tu marca (sitio web, redes, productos, categoría, mercados, rango de ventas, objetivos y presupuesto); los datos que nos da quien te recomienda; tu dirección IP, navegador, avance en la solicitud y actividad en nuestros correos; y los mensajes que nos envíes. Si formas parte de nuestro equipo de creadores o eres cliente, también datos patrimoniales o financieros necesarios para pagos y datos fiscales; para tratarlos te pediremos tu consentimiento expreso. No tratamos datos personales sensibles.
Finalidades primarias. Evaluar tu solicitud y considerarte para oportunidades futuras; contactarte por correo, WhatsApp, mensaje de texto o teléfono, incluidos recordatorios para terminar una solicitud e invitaciones enviadas por quien te recomendó; iniciar y administrar la relación si trabajamos juntos, incluidos contenidos, entregas y pagos; responder tus preguntas; y proteger nuestros sistemas contra fraude, spam y abuso.
Finalidades secundarias. Enviarte noticias, vacantes y ofertas; medir y mostrar nuestros anuncios en Facebook e Instagram (ver Tecnologías de rastreo); y analizar y mejorar nuestros servicios. Si no quieres que usemos tus datos para estas finalidades, escribe a privacy@ugccreatives.co, usa el enlace para darte de baja en cualquier correo o responde STOP. Puedes hacerlo en cualquier momento; negarte no afecta tu solicitud.
Remisiones. Compartimos tus datos con proveedores y socios de datos que los tratan por cuenta nuestra: servicios de nube y almacenamiento (Amazon Web Services), correo y mensajería (incluidos WhatsApp y Meta), herramientas de trabajo donde revisamos solicitudes (Notion), y herramientas de gestión de conocimiento, análisis e inteligencia artificial que usamos para organizar, resumir y revisar solicitudes. Estas remisiones no requieren tu consentimiento.
Transferencias. Podemos transferir tus datos, sin requerir tu consentimiento en los casos que permite la ley, a: las marcas con las que trabajes si formas parte de nuestro equipo, o a las que te propongamos, cuando sea necesario para la relación contigo; sociedades de nuestro mismo grupo; autoridades, cuando la ley lo exija; y un comprador o sucesor en caso de fusión, venta o reorganización. Tus datos se almacenan en servidores en Estados Unidos. No vendemos tus datos.
Tecnologías de rastreo. Guardamos un borrador de tus respuestas en el almacenamiento local de tu navegador y registramos tu avance, la apertura de nuestros correos y los enlaces o códigos de recomendación que usas. Este sitio también usa Google Analytics, a través de Google Tag Manager, para contar visitas y ver cómo se usa el sitio (páginas vistas, clics, navegador, dispositivo y ubicación aproximada por tu dirección IP, y si enviaste un formulario, pero no tus respuestas), y el píxel de Meta, que instala cookies y envía a Meta Platforms las páginas que visitas, cuándo las visitas, tu dirección IP, datos de tu navegador y dispositivo, y si enviaste una solicitud, un mensaje o te suscribiste a nuestro boletín. Cuando envías uno de esos formularios, nuestro servidor también envía a Meta ese mismo evento con tu correo y tu teléfono cifrados (en forma de hash), para que Meta lo relacione con una cuenta; no enviamos el resto de tus respuestas. Lo usamos para medir nuestros anuncios en Facebook e Instagram y mostrarlos a quienes visitaron el sitio; Meta trata esos datos conforme a su propio aviso de privacidad. Google Analytics y el píxel instalan cookies, y ninguno de los dos se carga si tu navegador envía una señal Global Privacy Control. Puedes bloquear o borrar estas tecnologías en la configuración de tu navegador y cambiar tus preferencias de anuncios en Facebook o Instagram.
Derechos ARCO y revocación del consentimiento. Puedes acceder a tus datos, rectificarlos, cancelarlos u oponerte a su uso, y revocar tu consentimiento. Escribe a privacy@ugccreatives.co desde el correo con el que nos contactaste e incluye: tu nombre y un medio para responderte; un documento que acredite tu identidad o, en su caso, la de tu representante; la descripción clara de lo que pides; y cualquier dato que ayude a localizar tu información. Te respondemos en un máximo de 20 días hábiles y, si procede, lo hacemos efectivo en los 15 días hábiles siguientes. Si consideras que tu derecho a la protección de datos personales ha sido vulnerado, puedes acudir a la autoridad competente en México.
Limitar el uso o divulgación. Además de lo anterior, puedes pedirnos que dejemos de enviarte invitaciones, recordatorios y comunicaciones de marketing con el enlace para darte de baja en nuestros correos, respondiendo STOP o escribiendo a privacy@ugccreatives.co.
Cambios. Publicaremos cualquier cambio a este aviso en esta página, con una nueva fecha.
